Danbury Man Suing for $10 Million

A Danbury man who was seriously injured in a collision last month between a car and a Metro North train in New York is planning to sue Metro North.

The accident happened on February 3 this year when 49 year old Ellen Brody of Edgemont was driving a Mercedes SUV which stopped on the railroad tracks at Commerce Street in Valhalla, after a gate came down on the rear of her vehicle. When the train hit her car, there was an explosion and the crash killed Brody and five passengers in the first rail car, including a man from Danbury.

Julia Gonzalo Loja Mendoza, a construction worker from Danbury, was riding in the middle of the first car, and was treated for injuries to his head, neck, spine, shoulders, chest and hands after jumping out a window from the burning train. His lawyer, Agostinho J. Ribeiro, says he has been unable to work since the accident and is suing the railroad, the Metropolitan Transportation Authority and New York state in a $10 million claim which has been filed by Manhattan attorney Robert Vilensky.
